TWISTED TEA ‘Round Trip to GREY CUP’ CONTEST CONTEST RULES AND REGULATIONS

1. CONTEST PERIOD
The ‘Round Trip to Grey Cup’ contest (the “Contest”) commences at 9:00:01 a.m. Eastern Standard Time (“EST”) on September 4th, 2018 and ends at 7:59 p.m. EST on September 30th, 2018, (the “Contest Period”). This Contest is brought to you by Moosehead Breweries Limited and The Premium Beer Company Inc. (collectively, the “Contest Sponsor”). No purchase necessary.

2. ELIGIBILITY

Contest is open to all legal residents of Canada (excluding the province of Quebec) who have reached the age of majority in their home province at the time of Contest entry.

Notwithstanding the above, this Contest is not open to employees of the Contest Sponsor, The Boston Beer Company, or their divisions, subsidiaries, affiliates, advertising and promotional agencies, Contest suppliers, employees and contractors of the provincial liquor agencies, liquor licensees and their employees, and members of their immediate families (parents, siblings, spouses) and those with whom they are domiciled.

3. HOW TO ENTER

Go to www.twistedtea.com/ and submit a completed online entry form during the Contest Period. Each submitted entry form will be entered in the Contest (an ‘Entry’ or ‘Entries’ submitted by an ‘Entrant’ or ‘Entrants’).

Each Entry must be made by the Entrant. Only one Entry per Entrant is permitted. Should an Entrant submit multiple entries, only the first submitted will be considered. Automated or robotic Entries submitted by individuals or organizations
will be disqualified. Any attempt by an Entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/prize draw subscription notification and/or entering services, will void that Entrant’s Entry (or Entries) and that

Entrant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All Entries must be posted by the end of the Contest Period in order to participate. The Contest Sponsor, CFL Enterprises LP, each of their respective parent, subsidiaries and affiliates and their respective agents, employees, directors, successors, and assigns (collectively, the “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void).

The Contest Sponsor reserves the right to disqualify Entries that it deems in its sole discretion to be harmful to individual users, Contest Sponsor, the communities that make up Twisted Tea, or any rights of the Contest Sponsor or its affiliates or any other party, including any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful or racially offensive, ethnically offensive, or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, provincial, national, federal or international law. An Entry may be rejected if, in the sole and absolute discretion of the Contest Sponsor the Entry is not submitted and received in accordance with these Contest rules during the Contest Period.

All Entries and Entrants are subject to verification at any time and for any reason. The Contest Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry and/or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Contest Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the Contest Sponsor’s interpretation of the letter and spirit of these contest Rules. Failure to provide such proof to the complete satisfaction of the Contest Sponsor within the timeline specified by the Contest Sponsor may result in disqualification in the sole and absolute discretion of the Contest Sponsor. The sole determinant of the time for the purposes of this Contest will be the official time-keeping device(s) of the Contest Sponsor.

By entering this Contest, you agree to abide by and be bound by these Contest rules and regulations and the decisions of the Contest Sponsor with respect to all aspects of the Contest, which decisions are final.

4. PRIZE
The prize package has an approximate retail value of $3,500.00 CDN (the “Prize”). The Prize consists of roundtrip airfare from a major airport, admission to the Grey Cup, hotel accommodations, a tailgate experience (as determined by Contest Sponsor) and a swag package for the Contest winner and one (1) guest. The trip will be a total of three (3) days and three (nights) stay in a hotel and the specific location of the seats will be determined by the “Contest Sponsor”. One (1) prize will be awarded for this contest.

The Prize must be redeemed no later than 4:59:00 EST on Friday, October 19th, 2018.

Prize must be accepted as offered and/or awarded and may not be transferred, exchanged or substituted, whether for cash or otherwise except as expressly provided in these Contest rules and regulations or at the Contest Sponsor’s sole discretion. No substitutes except at the Contest Sponsor’s option. The Contest Sponsor reserves the right to substitute a prize or prize component for one of equal or greater value. Notwithstanding the foregoing, the Contest Sponsor shall not be responsible to substitute a prize or portion thereof where such prize cannot be redeemed due to factors beyond its reasonable control.

The Contest Sponsor, together with its promotional, marketing or advertising agents and affiliated companies, reserve the

right to withdraw, amend or terminate this Contest at any time without prior notice. Unclaimed prizes will not be awarded. Return of any prize as undeliverable may result in disqualification. The costs of everything not specifically and expressly stated above as included in the Prize are the sole and absolute responsibility of the confirmed winner and his/her guest, including, without limitation: meals and drinks; gratuities; entertainment; health and travel insurance; transportation for confirmed winner and his/her guest to and from the Canadian airport selected by the Contest Sponsor; additional transportation; baggage and other fees; and items of a personal nature (NOTE: confirmed winner and/or his/her guest may be required to present a valid major credit card in his/her name at the time of hotel check-in to cover any incidental expenses). By accepting the Prize, the confirmed winner agrees to waive all recourse against the Released Parties (as defined below) if the Prize or a component thereof does not prove satisfactory, either in whole or in part.

Acceptance of a prize constitutes permission for the Contest Sponsor and its agencies to use winner’s name and/or likeness for advertising and promotional purposes without additional compensation, unless prohibited by applicable law. The Contest Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the Prize.

The Released Parties are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason, of any aspect of the Prize – including, but not limited to flight(s) or the game. Neither the confirmed winner nor his/her guest nor any other person or entity will be compensated in the event of such delay, cancellation or other event contemplated herein. The Contest Sponsor will not replace any lost or stolen tickets. Changes to flights and or passenger names are not accepted once bookings have been confirmed.

None of the Released Parties makes any representation or offers any warranty, express or implied, as to the quality or fitness of the Prize awarded in connection with the Contest. To the fullest extent permitted by applicable law, the confirmed winner and his/her guest understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from either the Contest Sponsor or any of the other Released Parties should his/her Prize fail to be fit for its purpose or is in any way unsatisfactory. For greater certainty and the avoidance of any doubt, by accepting the Prize, the confirmed winner agrees to waive all recourse against Contest Sponsor and all of the other Released Parties if his/her Prize or a component thereof does not prove satisfactory, either in whole or in part.

Following the end of the Contest Period, one winner from each of Canadian province and /territory (excluding Quebec)s AB, BC, MB, SK, and ON, will be randomly selected from all eligible Entries received. Residents of Quebec are not eligible. Contest Sponsor will attempt to contact the selected Entrant by telephone (“Initial Notification”), with further information on how to claim the Prize. The selected Entrant must accept the Prize as directed by the Contest Sponsor within 48 hours of Initial Notification. The selected Entrant will be required to provide proof of age and sign and return a Declaration and Release Form as presented by the Contest Sponsor.

If the selected Entrant cannot be reached or fails to respond to Initial Notification within the notice period provided above, for whatever reason, another Entrant may be selected from the remaining list of Entrants on or about October 12th, 2018, or the Prize [for that particular province or territory?] may be cancelled at Contest Sponsor’s sole discretion.

5. WINNER SELECTION & PRIZE NOTIFICATION

NO ONE IS A WINNER UNLESS AND UNTIL THE CONTEST SPONSOR OFFICIALLY CONFIRMS HIM/HER AS A WINNER IN ACCORDANCE WITH THESE RULES. BEFORE BEING DECLARED AS A CONFIRMED PRIZE WINNER, the eligible winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Contest Sponsor, be administered online, by email or other electronic means, by telephone, or in the Contest Sponsor’s form of declaration and release); and (b) sign and return within [five] ([5]) business days of notification the Contest Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these contest rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Released Parties from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Contest Sponsor in any manner or medium whatsoever, including print, broadcast or the internet. If the eligible winner: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; (c) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; and/or (d) is determined to be in violation of these Contest rules (all as determined by the Contest Sponsor in its sole and absolute discretion); then he/she will be disqualified (and will forfeit all rights to the Prize) and the Contest Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant for the Prize from among the remaining eligible Entries submitted and received in accordance with these Contest rules in accordance with the procedures outlined above (in which case the foregoing provisions of this section shall apply to such newly selected eligible Grand Prize winner).

6. GENERAL

In the event of any dispute regarding the interpretation of these Contest rules and regulations, the decision or interpretation of the Contest Sponsor shall prevail.

All Entries become the property of the Contest Sponsor. Any Entry that is illegible, incomplete, altered, or contains false information, is invalid. Contest SponsorThe Released Parties is are not responsible for lost, stolen, delayed, damaged or misdirected claims or Entries for any problems or technical malfunction of any internet or telephone network or broadcast transmission during the Contest Period. The Contest Sponsor is not responsible for any errors or omissions with respect to the printing or advertising of this Contest and reserves the right to withdraw, amend or cancel this Contest in the event of a printing or administrative error. The Contest Sponsor in its sole discretion may withdraw, amend, cancel, suspend, terminate or modify this Contest in any way, in whole or in part, without notice, for any reason including if it determines in its sole discretion that this Contest is no longer capable of running as intended, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause of any nature whatsoever.

The Contest SponsorReleased Parties accepts no responsibility for loss, damage or claims caused by the awarded Prize or the Contest itself. By entering, Entrant releases and holds harmless Contest Sponsorthe Released Parties, its affiliated and related companies and advertising, promotional agencies and all of their respective directors, officers, shareholders, employees, agents, successors and assigns (collectively, the “Contest Entities”) from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Contest or any Pprize won. Winner must comply with any applicable manufacturer warranty, terms and conditions and/or user guide for any Pprize won.

Without limiting the release of liability provisions herein, and for greater certainty, the Contest Entities will not be liable for: a) any incorrect or inaccurate information, whether caused by users of the Contest or by any equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of Entries in the Contest; b) any error, omission, interruption, deletion, defect or delay in the operation of the Contest or any transmission in connection with the Contest; c) any communications line failure, theft, destruction or unauthorized access to, or alteration of, Entries; d) any problems with, or technical malfunction of, any telephone network or lines, computer on- line systems, servers or providers, computer equipment, software, or failure of email which may occur for any reason whatsoever, including technical problems or traffic congestion on the Internet or at any website or combination thereof; or e) any injury or damage to Entrants’ or to any other person's computer related to or resulting from participating or downloading materials in this Contest.

Entries must be made only by the original, manual keystrokes of the individual Entrant. Use of any automated system including robotic or form filling software to enter or participate is prohibited and will result in disqualification of all Entries by anyone using such assistance.

In the event of a dispute as to who submitted an Entry, the Entry will be deemed to have been submitted by the Authorized Account Holder of the email account submitted at the time of Entry as determined by the Contest Sponsor. “Authorized Account Holder” is defined as the natural person who is assigned to email account by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Entrants may be required to provide the Contest Sponsor with proof that he/she is the Authorized Account Holder of the email address associated with such Entry.

The Contest Sponsor reserves the right at its sole discretion to disqualify any individual from the Contest, and to ban that individual from participation in any future promotion of the Contest Sponsor, if the Contest Sponsor finds or believes such individual to be tampering with the Entry process or the operation of the Contest or where applicable to be acting in violation of the Contest rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass the Contest Sponsor, the Contest Sponsor’s agencies, other Entrants or any other person. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE THE CONTEST SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. The Contest Sponsor’s failure to enforce any term of these Official Contest Rules shall not constitute a waiver of that provision.

By entering this Contest, you consent to the Contest Sponsor’s use, should you become a winner, of your name, place of residence and photograph or other likeness for publicity, advertising or informational purposes in any media or format (including the Internet) now or hereafter known throughout the world in perpetuity, without further compensation, notification, or permission, unless prohibited by law, in connection with this Contest or future similar contests. By entering, you declare that you have complied with the Contest rules.

This Contest is subject to all applicable laws and shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.

The invalidity or unenforceability of any provision of these Contest rules and regulations shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Contest rules and regulations shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

The provincial liquor agencies are not connected with this Contest in any manner whatsoever and are not liable in any way whatsoever to any matter which relates to this Contest.

The Contest is in no way sponsored, endorsed or administered by, or associated with, any social media website. You understand that you are providing your information to the Contest Sponsor and not to a social media website.
